1. INTRODUCTION

Property MarketBase (“PMB”, “we”, “us”, or “our”) a brand and service operated by MarketBase Media Inc., respects your privacy and is committed to protecting personal information in compliance with applicable privacy laws, including the Personal Information Protection and Electronic Documents Act (PIPEDA), Canada’s Anti-Spam Legislation (CASL), and applicable provincial privacy legislation, including Quebec's Act respecting the protection of personal information in the private sector (Law 25).

This Privacy Policy describes how PMB collects, uses, stores, shares, discloses, processes, and protects personal information obtained through our website, digital forms, communications, ad placements, advertising packages, and related platform features.

By accessing, browsing, creating an account, purchasing an advertising package, or otherwise using the PMB platform and services, you acknowledge that you have read and understood this Privacy Policy and consent to the collection, use, and disclosure of your personal information as described herein.

2. DEFINITIONS

In this Privacy Policy, the following terms have the meanings set forth below:

  • "Advertiser" means any individual, property owner, seller, landlord, builder, developer, corporation, partnership, authorized representative, or other person or entity that purchases an advertising package or submits property-related content for publication through PMB.
  • "Inquirer" means any user of the platform who submits an inquiry, message, or request for information regarding a property advertisement published on PMB.
  • "Personal Information" means any information about an identifiable individual, but does not include aggregated or anonymized data that cannot be linked back to a specific person.

3. INFORMATION WE COLLECT

PMB collects personal information directly from users, automatically through platform technologies, and from integrated third-party application providers.

We may collect the following categories of information:

  • Contact information, including names, email addresses, telephone numbers, and mailing addresses;
  • Commercial information, including general geographic property locations, property advertisement parameters, package selections, and transactional records;
  • User-generated content, including photographs, videos, floor plans, advertisement links, and associated property details;
  • Communication data, including message content, metadata, data routing communications, and platform inquiry data; and
  • Any other personal information voluntarily submitted to PMB via forms, support channels, or account configurations.

4. PROPERTY ADVERTISEMENT INFORMATION

Advertisers may submit information relating to properties, including property characteristics, features, specifications, pricing references, descriptions, photographs, videos, floor plans, promotional content, and related digital assets.

Such information will be publicly displayed on the internet as part of an active ad placement to facilitate the platform's digital advertising functions. Advertisers represent and warrant that they possess all necessary lawful authority, intellectual property rights, consents, and permissions required to submit such information to PMB for public dissemination.

5. INQUIRER AND INQUIRY INFORMATION

When an Inquirer submits an inquiry regarding an active ad placement through the platform, PMB collects information necessary to screen and route the communication, including:

  • Full name;
  • Email address;
  • Telephone number (where provided by the user);
  • Message content and specific inquiries;
  • The ad profile, property profile, or feature page of interest; and
  • Technical metadata related to the timing and origination of the inquiry.

6. AUTOMATICALLY COLLECTED INFORMATION

Whenever you interact with the platform, PMB automatically collects technical infrastructure data and electronic metrics. This information is utilized to maintain platform stability, security, and performance.

Automatically collected information includes:

  • Internet Protocol (IP) addresses and geolocation indicators;
  • Browser type, version, and language settings;
  • Device information, hardware models, and operating system attributes;
  • Clickstream data, including pages visited, timestamps, duration of visits, and referring/exit websites;
  • Cookie identifiers, tracking pixels, and clear GIFs; and
  • E-commerce analytics and transactional path data.

7. COOKIES AND TRACKING TECHNOLOGIES

PMB utilizes cookies, pixels, web beacons, tags, and related analytics and advertising technologies to optimize platform functionality. These tracking mechanisms are used to:

  • Authenticate users and operate the website storefront and e-commerce architectures;
  • Analyze platform performance, monitor uptime, and identify technical errors;
  • Understand user browsing activity, search patterns, and interactions with ad placements;
  • Measure the reach and effectiveness of promotional content and advertising campaigns;
  • Personalize user experiences, remember account preferences, and retain settings; and
  • Support platform marketing, retargeting, and behavioral remarketing activities across third-party networks.

Users may manage their cookie preferences by adjusting their internet browser settings to block or delete cookies. If a user rejects or disables cookies, certain features, functionalities, or secure areas of the platform may become unavailable or fail to function as intended.

8. HOW WE USE INFORMATION

PMB processes personal information based on lawful business purposes, contractual necessity, or explicit user consent. We use collected information to:

  • Operate, maintain, host, and administer the digital platform and website storefront;
  • Publish, display, format, and manage active ad placements on behalf of Advertisers;
  • Process user inquiries, generate leads, and forward communications through secure workflows;
  • Provide user support, respond to complaints, and resolve technical or operational issues;
  • Process e-commerce transactions, verify billing details, and manage renewals;
  • Improve platform functionality, enhance user interfaces, and develop new features;
  • Conduct system analytics, data modeling, performance reporting, and market research;
  • Detect, investigate, and prevent fraudulent activity, unauthorized web scraping, security breaches, and platform abuse;
  • Enforce our Terms of Service, Privacy Policy, and other operational agreements; and
  • Comply with standard legal obligations, regulatory requirements, tax audits, or valid law enforcement requests.

9. COMMUNICATIONS AND MARKETING

PMB may send various electronic communications to users, categorized as follows:

  • Transactional and Operational Communications: Including inquiry notifications, transaction confirmations, ad package invoices, renewal reminders, security alerts, and platform policy updates. These communications are necessary for the delivery of the services and do not require promotional opt-in consent.
  • Marketing and Promotional Communications: Including platform newsletters, promotional offers, marketing updates, and advertising opportunities.

In accordance with Canada’s Anti-Spam Legislation (CASL), promotional communications will only be transmitted where express or implied consent has been obtained. Users may withdraw their consent and unsubscribe from promotional communications at any time by utilizing the "unsubscribe" link embedded within the message or by contacting the PMB Privacy Officer directly. Unsubscribing from marketing materials will not impact your receipt of critical transactional or operational notifications.

10. AI, AUTOMATION, AND CONTENT PROCESSING

PMB integrates artificial intelligence (AI) systems, machine learning models, natural language processing tools, and algorithmic automation workflows to support platform operations. These technologies are deployed to automate ad content preparation, text formatting, property categorization, communication routing, content moderation, fraud screening, and administrative performance monitoring.

These automated systems may be hosted, operated, or maintained by third-party artificial intelligence, cloud computing, and infrastructure service providers. PMB employs administrative oversight to ensure that the deployment of automated systems adheres to our data protection principles and does not compromise the security or integrity of your personal information.

11. INQUIRY ROUTING AND PRIVACY

When a User submits an inquiry or communication form through the Platform, PMB may receive the inquiry and forward or route the submitted contact information, message content, and related information to the Advertiser, builder, developer, or authorized representative associated with the applicable Property Advertisement.

By submitting an inquiry through the Platform, the User authorizes PMB to receive, process, and transmit the information provided in the inquiry to the applicable independent third-party Advertiser for the purpose of facilitating communication regarding the Property Advertisement.

PMB may review communications as reasonably necessary for administrative, security, technical, legal, or operational purposes, but does not undertake to screen, verify, qualify, investigate, or evaluate prospective buyers, inquirers, or the content of inquiries before forwarding them.

Once information is transmitted to an Advertiser, it may be subject to that Advertiser's independent privacy policies and data management practices. PMB does not control how independent Advertisers use, retain, or disclose personal information after it has been transmitted to them.

PMB may retain inquiry information and related records for legitimate operational, security, customer support, recordkeeping, and legal compliance purposes in accordance with this Policy and applicable law.

PMB does not control or monitor communications occurring outside the Platform, including communications conducted through telephone calls, text messages, external email, social media, third-party messaging services, or in-person interactions.

12. THIRD-PARTY SERVICE PROVIDERS

PMB transfers personal information to reliable third-party service providers, cloud infrastructure vendors, and e-commerce application partners who perform operational functions on our behalf. These external providers are classified across the following operational categories:

  • Website hosting providers and cloud-based content delivery networks (CDNs);
  • Cloud infrastructure, storage arrays, and database management vendors;
  • Integrated payment gateways and financial transaction processors;
  • Analytics utilities, diagnostic platforms, and behavioral measurement services;
  • Email distribution networks and communication routing infrastructures;
  • Artificial intelligence processing systems, automation modules, and machine learning endpoints;
  • Video hosting platforms and rich media display networks; and
  • Digital advertising, audience matching, and marketing automation utilities.

PMB utilizes contractual and administrative safeguards to ensure that third-party service providers protect the confidentiality of personal information, treat it as strictly proprietary, and restrict its processing solely to the performance of authorized services on behalf of PMB. A list of current core platform application providers may be requested by contacting our Privacy Officer. PMB is not responsible for the independent privacy practices of external parties when they operate beyond our direct instructions.

13. SHOPIFY PLATFORM SERVICES

PMB utilizes Shopify and related Shopify services to operate portions of its website, storefront, payment processing integrations, analytics tools, and platform infrastructure.

As a result, certain personal information may also be collected, processed, stored, transmitted, or otherwise handled by Shopify and its affiliated service providers.

PMB does not control Shopify's independent privacy practices, policies, updates, platform disclosures, or data processing activities. Shopify may modify its privacy policies, disclosures, and related documentation from time to time without notice to PMB.

14. PAYMENT INFORMATION

To maintain the highest tier of financial security, PMB does not directly collect, capture, store, or process payment card numbers, bank account numbers, or related credit credentials. All financial transactions and checkout flows are managed through secure, integrated third-party payment gateways compliant with the Payment Card Industry Data Security Standard (PCI-DSS).

PMB receives transaction confirmations, ad package selection logs, generalized billing details (such as postal/zip codes and country), payment status updates, and corresponding transaction reference IDs necessary to validate accounts, activate ad placements, and maintain corporate financial ledger accounting.

15. DATA RETENTION

PMB retains personal information only for as long as reasonably required to fulfill the objectives outlined in this Privacy Policy, satisfy contractual terms, maintain active advertising infrastructure, or comply with mandatory statutory, tax, accounting, and legal requirements.

We determine data retention periods based on the volume, nature, and sensitivity of the information, the potential risk of harm from unauthorized use or disclosure, and the specific retention mandates under applicable laws. Following the expiration of the retention threshold, personal information is deleted, destroyed using secure methods, or irreversibly anonymized so that it can no longer be linked to or associated with an identifiable individual.

16. ACCESS, CORRECTION, DELETION, AND PRIVACY REQUESTS

PMB is committed to providing individuals with clear mechanisms to exercise their legal privacy rights. Depending on your jurisdiction of residence (including PIPEDA frameworks in Canada and Law 25 parameters in Quebec), you possess the following rights regarding your personal information:

  • Right of Access: The right to confirm whether we process your personal information and to request a copy of the specific pieces of data held by PMB;
  • Right to Rectification: The right to request the correction, modification, or updating of inaccurate, incomplete, or obsolete personal information;
  • Right to Deletion (Erasure): The right to request the deletion or removal of your personal information from our active databases, subject to legal and contractual exceptions; and
  • Right to Withdraw Consent: The right to revoke or withdraw any consent previously granted for the collection, processing, or disclosure of your personal information.

To exercise these rights, please submit a formal written request to our designated Privacy Officer using the contact information provided in Section 20. Upon receiving a request, PMB will take steps to verify the identity of the requestor prior to processing or releasing any personal data.

PMB will respond to all verified requests within thirty (30) days, or within the statutory timelines mandated by your local jurisdiction. Please note that PMB may lawfully decline or restrict a request where the retention or processing of personal information is strictly required for legal defense, regulatory compliance, historical tax accounting, fraud prevention, security maintenance, or the execution of ongoing contractual agreements.

17. SECURITY

PMB implements administrative, physical, technical, and digital security measures designed to safeguard personal information against accidental loss, unauthorized access, destruction, modification, or disclosure. These measures include data encryption in transit and at rest, secure access controls, firewall monitoring, and restricted employee access permissions.

While we employ industry-standard protocols to protect our systems, no method of transmission over the internet, cloud storage architecture, or automated data processing workflow can be guaranteed to be absolutely secure. PMB cannot guarantee that unauthorized third parties will never circumvent our security perimeters. Users transmit information to the platform entirely at their own risk.

18. SECURITY INCIDENTS AND BREACH RESPONSE

PMB may investigate, document, contain, mitigate, and respond to actual or suspected security incidents, unauthorized access events, data breaches, cyber-attacks, fraud attempts, or other security-related events affecting the Platform or personal information.

Where required or permitted by applicable law, PMB may notify affected individuals, regulatory authorities, law enforcement agencies, insurers, cybersecurity professionals, or other relevant parties regarding security incidents involving personal information.

PMB reserves the right to take any reasonable measures necessary to protect the security, integrity, availability, and lawful operation of the Platform, Services, and personal information under its control.

19. INTERNATIONAL PROCESSING AND CROSS-BORDER TRANSFERS

PMB and its integrated software application providers may store, process, host, transfer, or access personal information in jurisdictions outside your home province, territory, or country of residence, including Canada, the United States, and European cloud center regions.

When personal information is transferred across international borders or processed outside your home jurisdiction, it becomes subject to the laws, statutes, and governmental regulations of that external jurisdiction. Foreign law enforcement agencies, regulatory bodies, and national security courts may therefore be granted lawful access to your personal information under the local legal frameworks of those countries. By utilizing the platform, you acknowledge and consent to the cross-border transfer, storage, and processing of your personal data.

20. AGE REQUIREMENT

The PMB platform, advertising packages, and communication routing services are designed strictly for use by adult individuals and corporate entities. The platform is not directed toward, marketed to, or intended for individuals under eighteen (18) years of age. PMB does not knowingly collect, harvest, process, or maintain personal information from minors. If we discover that personal information of a minor has been inadvertently collected, we will permanently purge that data from our production databases immediately.

21. CHANGES TO THIS PRIVACY POLICY

PMB reserves the right to modify, amend, update, or replace this Privacy Policy at any time to reflect changing technical capabilities, updated operational protocols, shifting platform features, or evolving global privacy legislation.

When revisions are made, we will post the updated Privacy Policy directly on this page and revise the "Last Updated" date displayed at the top of the document. We recommend that users review this policy periodically to stay informed about how we safeguard personal information. Your continued access to, browsing of, or active interaction with the platform following the publication of any modifications constitutes your formal acceptance of the revised Privacy Policy.
